Very often in a divorce claim, one party will have a significant financial advantage over the other, which can create an unfair set of circumstances and potentially force the “weaker” party to abandon part of a claim or accept a low financial settlement for fear of being unable to pay the costs of litigating the claim. This has nothing to do with the strength of that person’s claim – it is merely a reflection of access to funds, which may be controlled entirely by the other party.
